www.lisaedels.com (hereinafter the website) is the online store of Lisa Edels GmbH, Lindenstrasse 16, 6340 Baar, Switzerland. In the following, the term customer is used for all purchasers of products from the online store, regardless of gender.
The General Terms and Conditions (hereinafter referred to as the GTC) apply to all orders placed on the website. Before ordering products from this website, the customer is required to read the GTC carefully. By clicking on the "GTC" box when purchasing a product, the customer declares his full agreement with these provisions. In addition, the customer confirms that he/she has legal capacity and is at least 18 years old.
Lisa Edels GmbH executes an order in accordance with the version of the GTC valid at the time of the order. The GTC can be downloaded and printed out by the customer at any time on the website under the heading "GTC/Data Protection Declaration".
Regulations that deviate from the GTC are only recognized if this is confirmed in writing by Lisa Edels GmbH.
All products offered on the website (hereinafter referred to as the product(s)) do not constitute binding offers by Lisa Edels GmbH, but are invitations to make an offer. By placing an electronic or telephone order, the customer submits an offer to Lisa Edels GmbH. Lisa Edels GmbH is completely free to decide whether or not to accept the customer's offer.
By placing an order on the website (via the "Buy" button in the online store) or by telephone, the customer makes a binding offer. The essential contents of the contract are clearly and comprehensibly presented to the customer in a highlighted manner immediately before the binding order is placed. Lisa Edels GmbH confirms receipt of the customer's order by e-mail. This confirmation of receipt is not a binding acceptance of the order. The contract is only deemed to have been concluded when Lisa Edels GmbH
Lisa Edels GmbH reserves the right to refuse orders from customers where it has reason to believe that a potential customer is in breach of the GTC, is involved in fraudulent or other criminal activity or has another valid reason.
All prices are based on the order confirmation sent by Lisa Edels GmbH (see section 2 above). For domestic deliveries, they include the statutory Swiss value added tax (8%). For exports to other countries, the net price includes the respective approximate VAT. Any minor adjustments to the actual foreign value added tax are reserved. For all deliveries abroad, additional taxes and customs duties are to be borne by the customer (see section 9 below). A separate invoice will be issued by the delivery service (see section 10 below).
The ordered products are delivered in accordance with the order documents sent by Lisa Edels GmbH. The gemstones and diamonds processed by Lisa Edels GmbH are natural products; their properties may therefore differ slightly from the images and information on the website. We also reserve the right to make minor design changes in the course of jewelry production.
The products on the website are available while stocks last. Lisa Edels GmbH reserves the right to change or remove the products listed on the website at any time and without prior notice and, if necessary, to limit the number of products available for purchase by a customer.
Any liability of Lisa Edels GmbH for lack of stock, delayed delivery or non-availability of products is excluded. If a delivery cannot be made due to the aforementioned reasons, the customer will be notified (see section 10 below).
All Lisa Edels GmbH products can be customized according to individual customer requirements. These are to be communicated in advance in writing to the address provided in the imprint of the website. Once the order has been confirmed, requests for changes and cancelation orders can usually no longer be considered.
The customer may exchange the product for an equivalent product within 14 days of receipt of the product, provided that the former is in perfect original condition, in its original packaging and has not been used. The customer is obliged to inform Lisa Edels GmbH immediately about the exchange via e-mail sparkle@lisaedels.com. For a proper exchange, the customer has to hand over the product in due time to the courier service organized by Lisa Edels GmbH according to their instructions. Lisa Edels GmbH reserves the right to refuse the exchange if the aforementioned conditions are not met. All products customized for the customer are excluded from exchange. The costs for the return shipment shall be borne in full by the customer.
The customer may return the product within 14 days of receipt, provided that it is in perfect original condition, in its original packaging and has not been used. The customer is obliged to inform Lisa Edels GmbH immediately about the return via e-mail (info@lisaedels.com). For a proper return, the customer has to hand over the product in due time to the courier service organized by Lisa Edels GmbH according to their instructions. Lisa Edels GmbH reserves the right to refuse the return in case of non-compliance with the aforementioned conditions. All products customized for the customer are excluded from return. The costs for the return shipment shall be borne in full by the customer.
If a return is accepted by Lisa Edels GmbH, it will refund the customer the purchase price paid.
The customer agrees that contract-related communication with Lisa Edels GmbH may take place in electronic form.
Lisa Edels GmbH attaches great importance to protecting the personal rights of its customers. Its web store is subject to the Swiss Data Protection Act (hereinafter DSG). The following provisions apply solely to the Lisa Edels GmbH website. Third-party websites that can be accessed via the Lisa Edels GmbH website are not subject to the following regulations. Lisa Edels GmbH accepts no responsibility or liability whatsoever for the content of third-party websites.
As part of the ordering process, Lisa Edels GmbH collects the customer's first and last name, address, e-mail address and, if applicable, other data such as telephone numbers, size or date of birth. No particularly sensitive personal data within the meaning of the FADP is collected. Lisa Edels GmbH is aware that the stored information constitutes personal data within the meaning of the FADP. It therefore collects, stores and uses this information solely in accordance with the provisions of Swiss data protection law. Lisa Edels GmbH uses suitable technical and organizational measures to protect the personal data of customers from loss, theft and misuse. However, no liability can be accepted for the security of data transmitted via the Internet. The transmission of data is encrypted.
Lisa Edels GmbH stores and processes the customer's data for the purpose of processing the contract. The customer agrees to receive information material from Lisa Edels GmbH from time to time for advertising purposes (such as newsletters, product information, etc.) by post or e-mail. The customer can unsubscribe from this information at any time by sending an e-mail to sparkle@lisaedels.com or by sending a postal message to the address published in the imprint of the website.
Lisa Edels does not pass on any personal data to third parties, either in Switzerland or abroad. An exception to this is the forwarding of data to third parties:
The customer hereby consents to the collection, storage and use of personal data as described above. He has the right at any time to request information about his data stored by Lisa Edels GmbH free of charge or to revoke his consent and to request blocking or deletion. In the latter case, Lisa Edels GmbH will delete the data concerned within 30 days. Requests must be sent in writing by e-mail to sparkle@lisaedels.com or by post to the address published in the legal notice of the website.
The purchase price for the ordered products is due upon receipt of the order confirmation from Lisa Edels GmbH.
The customer is free to pay the purchase price in advance (bank transfer to account no. [●], IBAN [●], BIC [●]) or PayPal (by clicking on the PayPal logo on the website). Lisa Edels GmbH can also determine other payment methods. In the event of late payment, Lisa Edels GmbH may withdraw from the contract without further ado.
In the case of deliveries abroad, the customer must pay customs duties and taxes separately to the delivery service (see Section 10 below). The customer will receive a separate invoice from the delivery service (see section 3 above).
The customer may only offset the purchase price claim against undisputed or legally established claims against Lisa Edels GmbH.
The ordered products are usually sent within 30 days of receipt of payment by delivery service as an insured shipment to the address specified by the customer. In the case of specially marked products, shipment may take place later under certain circumstances. Lisa Edels GmbH accepts no liability for delays in delivery for which the delivery service is responsible.
If the ordered product cannot be delivered within 40 days after receipt of payment, Lisa Edels GmbH may withdraw from the contract, even if it has previously confirmed the conclusion of the contract to the customer. In the event of such a withdrawal, Lisa Edels GmbH shall inform the customer of the unavailability of the product and refund the purchase price paid without delay.
Ownership of the product is transferred to the customer upon full payment of the purchase price.
The risk shall pass to the customer upon conclusion of the contract (see section 2 above).
Lisa Edels GmbH insures all products shipped by it up to a maximum of the product value.
If the ordered product is defective at the time of the transfer of risk (see section 10 above), the customer may, at his discretion, demand the rescission of the contract or, if the product is still available, the replacement by a defect-free, equivalent item. An independent guarantee is not granted beyond this. The warranty period shall commence upon receipt of the goods and shall be two years.
Lisa Edels GmbH shall only be liable to the customer in the event of damage caused intentionally or through gross negligence. No liability is accepted for data errors, incorrect prices, errors in illustrations, product descriptions or other texts. This does not apply to the absence of warranted characteristics.
Exclusion and limitation of liability claims shall always also apply to any claims against employees or agents of Lisa Edels GmbH.
All image rights are held by Lisa Edels GmbH. Any use without express permission is prohibited.
The customer may only assign his contractual rights to third parties with the written consent of Lisa Edels GmbH.
Should one or more provisions of these GTC be or become invalid or unenforceable in whole or in part, this shall not affect the validity of all other provisions or agreements. The wholly or partially invalid or unenforceable provision shall be replaced by a provision that comes as close as possible to the economic purpose of the invalid or unenforceable provision in a legally permissible manner in accordance with the mutual agreement of Lisa Edels GmbH and the customer.
The contract between Lisa Edels GmbH and the customer shall be governed by Swiss law to the exclusion of any further reference. The United Nations Convention on Contracts for the International Sale of Goods of 1980 (Vienna Sales Convention) is excluded.
The ordinary courts in Zug, Switzerland shall have sole jurisdiction for all disputes arising from or in connection with these GTC.
Lisa Edels GmbH is also entitled to sue the customer at the competent court of his place of residence or at any other competent court.
